Akera SMM Terms of Service

1. Acceptance of Terms

By accessing or using Akera SMM at smm.akera.agency (the "Service"), operated by Akera Agency ("Akera," "we," "us," or "our"), you agree to be bound by these Akera SMM Terms of Service ("Terms"). If you do not agree to these Terms, do not use Akera SMM.

2. Description of Service

Akera SMM is a social media management platform that allows you to schedule, publish, and manage content across multiple social media platforms, including but not limited to TikTok, Instagram, YouTube, LinkedIn, X/Twitter, Facebook, Pinterest, Threads, and Bluesky.

3. Account Registration

  • You must provide accurate, complete, and current information when creating an Akera SMM account
  • You are responsible for maintaining the confidentiality of your Akera SMM account credentials
  • You are responsible for all activities that occur under your Akera SMM account
  • You must be at least 18 years old to use Akera SMM
  • You must notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use Akera SMM to:

  • Violate any applicable laws, regulations, or third-party rights
  • Post or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Spam, send unsolicited messages, or engage in deceptive practices
  • Infringe on intellectual property rights of others
  • Attempt to gain unauthorized access to Akera SMM or its systems
  • Interfere with or disrupt Akera SMM or servers connected to the Service
  • Use automated means to access Akera SMM except through our provided API
  • Violate the terms of service of any connected social media platform

5. Social Media Platform Integrations

When you connect third-party social media accounts to Akera SMM:

  • You authorize Akera SMM to access and interact with those accounts on your behalf, limited to the permissions you grant
  • You are responsible for complying with each platform's terms of service and community guidelines
  • We are not responsible for any actions taken by external platforms regarding your account or content
  • You may disconnect any social media account at any time through your Akera SMM settings
  • We do not guarantee uninterrupted access to external platform APIs, which may change or become unavailable

6. Content Ownership

You retain all ownership rights to the content you create and publish through Akera SMM. By using Akera SMM, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service to you.

You represent and warrant that you have all necessary rights to the content you upload to Akera SMM and that your content does not infringe on any third-party rights.

7. Service Availability

We strive to maintain high availability of Akera SMM but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue Akera SMM (or any part of it) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Akera and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use Akera SMM, even if we have been advised of the possibility of such damages.

9. Disclaimer of Warranties

Akera SMM is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify, defend, and hold harmless Akera and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of Akera SMM, your content, or your violation of these Terms.

11. Termination

We may terminate or suspend your Akera SMM account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use Akera SMM ceases immediately. You may also delete your account at any time.

12. Changes to These Terms

We reserve the right to modify these Akera SMM Terms of Service at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of Akera SMM after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Akera Agency operates, without regard to its conflict of law provisions.
